Supreme Court: Witness testimony needs formal order if accused absconds

The Supreme Court ruled that witness testimony recorded without a formal order under Section 299 of the Criminal Procedure Code (CrPC) cannot be used against an accused who has absconded. The court stated that such evidence is inadmissible if the trial court did not pass a specific order for recording testimony under this section. This decision clarifies the procedure for using evidence when an accused person evades trial.
