Court Rulings Clarify Cheque Bounce Case Liability

The Orissa High Court ruled that a trustee can face a cheque bounce case even if the trust is not made an accused. Separately, the Supreme Court stated that mere denial is insufficient to rebut the presumption under the Negotiable Instruments (NI) Act in cheque bounce cases. However, in a conflicting ruling, the Supreme Court also quashed a cheque bounce case against a director, stating the company must be made an accused. India Today reported that settling a cheque bounce case after conviction may still be possible.
