Allahabad High Court: POCSO and Child Marriage Act override Shariat on marriage age
The Allahabad High Court has ruled that the Prohibition of Child Marriage Act, 2006, supersedes Muslim Personal Law (Shariat) regarding the minimum age of marriage. The court stated that a Muslim girl cannot be married solely upon attaining puberty, as this conflicts with the POCSO Act and the Child Marriage Prohibition Act. This decision clarifies that the prohibition on child marriage applies universally.
