Courts Rule Pavement Sleepers Not Negligent in Accidents

Indian High Courts in Delhi and Kerala have ruled that individuals sleeping on pavements or acting as pillion riders are not contributorily negligent in accident cases. The Delhi High Court stated that sleeping on a pavement does not add to an offending driver's negligence and enhanced compensation for victims. Similarly, the Kerala High Court clarified that a pillion rider is not responsible for the rider's negligence. These judgments aim to ensure victims receive full compensation without deductions for their perceived negligence.
